TPIL Lawyers Privacy Policy

TPIL Lawyers Pty Ltd (TPIL) is committed to protecting your privacy ensuring that Personal Information held by the company is treated confidentially.

This Privacy Policy outlines how TPIL collects, uses, stores, and discloses Personal Information in accordance with the the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy applies to all Personal Information collected directly and or through third parties and their platforms. You consent to our use of that information to: (i) respond to and assist with an enquiry; (ii) investigate, process, progress and resolve your legal matter; and/or (iv) offer other services that may be relevant to your circumstances. If you do not provide this information, we may be unable to deliver our legal services.


What is ‘Personal Information’

We collect, receive, use, disclose and hold the following types of information:


‘Personal Information’
refers to information or an opinion that could reasonably identify an individual. It includes names, addresses, email addresses, telephone numbers, file notes, medical or financial records, IP addresses, online identifiers, and other data collected in the course of delivering legal services. For recruitment purposes, this also includes your CV, cover letter, academic transcripts, employment history, and documentation verifying your eligibility to work in Australia.


‘Sensitive Information’
is a specific category of Personal Information that covers details or opinions about an individual’s racial or ethnic background, political views, religious or philosophical beliefs, membership in political, professional, or trade organisations or unions, sexual orientation or behaviour, criminal history, health or genetic information including information about physical and mental health, notes on symptoms, diagnosis, disability and treatment, information about suitability for work and other health related information, and some aspects of biometric information.


‘Government Related Identifiers’
(GRI) are unique numbers, letters, or symbols issued by a State or Territory authority or agency for the purpose of identifying an individual or confirming their identity. Examples include Tax File Numbers, Medicare numbers, Centrelink reference numbers, driver’s licence numbers, and passport details. We collect, receive, use, disclose, and manage GRI only as permitted by law.
We collect, receive, use, disclose, and otherwise process Personal Information only when it is reasonably necessary for us to do so, and primarily for the purpose of providing you with our legal services or assessing your suitability for employment or business opportunities with us.

In some circumstances, we may also need to handle special categories of Personal Information, such as financial information or medical records, in order to deliver our legal services.


Collection and Retention of Personal Information

We may collect Personal Information directly or indirectly from you or from a third party either directly or through interaction with our platforms, systems and services. Collection occurs in circumstances including, but not limited to:

• Submission of enquiries or completion of forms on the website
• Communication via phone or email
• Use of online tools or interaction with digital platforms
• Engagement for legal services
• Inquiries or responses regarding employment opportunities
• Inquiries or responses regarding sponsorships or other business opportunities
• Deployment of third-party software, digital platforms or CRM systems that record user activity, traffic data and engagement behaviour
• Storage of matter-related information in legal practice management systems or other third-party software, including case files, emails and communication records
• Logging of visits by hosting providers to the website or platforms, including time and date of visit, pages viewed, browser type and referring websites which may generate analytics data
• Monitoring or recording of telephone calls for training and security purposes, as well as to assist in creating accurate file notes
• Operation of CCTV at the premises to ensure a safe and secure environment for all visitors.

Where relevant to a matter, a legal enquiry or an employment application, and where permitted by law, we may also collect and share personal information from third parties (for example, professionals, doctors, insurers, government departments, recruitment agencies, or your nominated referees) and from publicly available sources (such as professional social media profiles).

We retain personal information for at least seven years—even after your relationship with us ends—and otherwise for as long as required to comply with legal, regulatory, and professional obligations, after which it will be securely destroyed or de identified. Information may be stored in secure third party practice management or other systems we use.


Collection of Personal Information for Legal Compliance

In providing our services, we are required to collect certain Personal Information to meet a range of legal, regulatory, and operational obligations. These requirements ensure we can deliver our services responsibly, maintain the integrity of our systems, and comply with applicable laws.

For some services, we may also be considered a “reporting entity” under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act) and associated Rules. This legislation requires us to collect specific Personal Information to verify your identity and, where applicable, the identity of beneficial owners of an entity (often referred to as “Know Your Customer” or “KYC” procedures).


Use and Disclosure of Personal Information

We use Personal Information to:

• Provide legal services, advice, and representation
• Communicate with you or third parties regarding your legal matter, enquiry or application
• Manage ongoing matters, facilitate legal workflows and maintain our practice management systems
• Process and assess employment applications, including verifying your work history, qualifications, and suitability for current or future roles
• Comply with legislative, regulatory, and professional obligations that may include lawful background or police checks
• Respond to complaints, disputes, or legal proceedings
• Improve our website, digital services, recruitment processes and general client experience.

We may disclose Personal Information to:

• Our legal practice software provider, HR management systems, and third-party software providers
• Web analytics platforms (e.g. Google Analytics)
• External IT service providers and contractors with confidentiality obligations
• Professional advisors, insurers, medical professionals or barristers, or recruitment agencies
• Referees (with your permission) to verify employment or education history
• Courts, tribunals, government departments or regulators where required by law
• Our staff.

We do not sell or rent Personal Information. We take reasonable steps to ensure that third parties maintain the confidentiality and security of your information in accordance with the Privacy Act.


Use of Artificial Intelligence Tools

We may use AI‑enabled features within enterprise systems (e.g., document automation, analytics etc.) in the delivery of some services or for internal operations. Were practically possible we use AI services that align with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Where AI tools are supplied by third-party providers, we take reasonable steps to ensure those providers maintain privacy and security standards consistent with Australian law. We do not use AI for automated decision making that has legal or similarly significant effects on individuals.


Email Marketing and Marketing & Communications

We only send direct marketing when permitted under the law, including where you have consented or where you are an existing client.

If you have registered to receive communications from us, we may use your contact details to send you newsletters, information, marketing emails or invitations to TPIL Lawyers seminars or events, which may be of interest to you.

You may at any time opt out of receiving such materials by contacting us directly or using the unsubscribe link in our emails.


Accessing and correcting Personal Information

You may request to obtain your Personal Information or request corrections where data is inaccurate, out of date or incomplete. We will process all requests for access to Personal Information in accordance with the Australian Privacy Principles.

If, upon receiving access to your Personal Information, or at any other time, you believe the information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.

We may need to verify your identity before providing access to or correcting your Personal Information.
In most cases, we will provide you with access to your Personal Information. However, we may refuse access in certain situations as listed in the Australian Privacy Principles.


Storage and Security of Personal Information

TPIL will take reasonable steps to protect your personally identifiable information from loss, misuse or alteration, unauthorised access, or disclosure.

The majority of your information may be stored in Australia. We minimise the exposure to storage of any information overseas and take reasonable steps to protect it in a manner consistent with the Australian Privacy Principles, including through contractual safeguards, due diligence, and security controls. We may use data encryption, password protection, access controls, and other safeguards to ensure data integrity and privacy.


Cookies, Analytics and Server Logs

We use cookies, pixels, analytics tools and server logs – both our own and those provided by third-party service providers – to operate and secure our website, understand usage patterns, improve our services, and where permitted, tailor content and marketing. The information collected may include your IP address, server address, device and browser type, pages accessed, time and date of visit, and the site you visited immediately beforehand. We use essential cookies that enable the website to function, analytics cookies that help us understand and improve how the site is used, and marketing cookies that support limited advertising and content personalisation where permitted.
