Trouble in paradise: what happens if you’re injured while on holiday?

Is there any more idyllic place to visit for a holiday than the beautiful state of Queensland? Golden sand, the world’s best surf and incredible world-heritage rainforests. There is so much to see, and so many exciting adventure activities to take part in.  Is it any wonder that more than 21 million domestic and international overnight visitors came to Queensland in the year ending March 2022.

But what happens if you are injured and your dream holiday ends up becoming a nightmare?

In January 2023, holidaymakers in Currimundi on Queensland’s Sunshine Coast witnessed two tandem skydivers helplessly plummet towards the ground after their parachute failed to open.  Thankfully, on this occasion, their reserve chute deployed just in time to avoid a catastrophic outcome.

Earlier this month, four people were killed and many more were left traumatised when two helicopters on a joy flight collided mid-air at the Gold Coast’s Sea World theme park.

On 25 October 2016, four people tragically lost their lives on a visit to Dreamworld when the Thunder River Rapids ride they were on malfunctioned.

You have rights should an accident happen

Many people are unaware that they may have legal rights or an entitlement to compensation following such a devastating event.  The payment of compensation is not limited to just those directly involved in the event – often the first responders are left traumatised by what they have experienced, and any bystanders or other witnesses may have also suffered trauma or otherwise been injured because of it.

Although described as ‘tragic accidents’, often, unfortunately, these are not accidents – someone is at fault for what has happened.

So, how does injury compensation work?

If you have suffered an injury because of somebody else’s actions, generally speaking, you will be entitled to compensation. It may not immediately be obvious who is at fault or who is responsible to pay compensation to you or how much compensation you might be entitled to.
